The fightt for copyright rights.

Hi everyone:

Well I worked on a project for a business using VB and now the client wants
the copyright, in order to close the deal Iam ready to give it to him but
not the source code. I figure a checks a check and I don't care about doing
any more business with him since he didn't read or sign my instrument of
agreement. What do you guy's think should I let him have it, so I can move
on with my business.

Copyright law can be confusing, so before doing anything consult a lawyer.

Shouldn't it be the other way around?

Let him get the source but not the copyright. You may want to reuse
some of that code, or parts of it. If you give him the copyrights, you
can not legally use any of that code again, and may end up in trouble
if you program something similar for another client.

If it was a retail product, and a second client asks for a similar
product, then it becomes more likely that you could get burned. You
can avoid that situation by retaining the copyright.

Keeping the source code only keeps the client from hiring someone
else to modify your work. From the sound of it, you do not want
to deal with that guy again. (So who cares what he does with it) But,
whoever owns the copyrights holds the rights to selling copies. If
that is exactly what your client wanted, then you can allow it, without
giving up ownership.

If what you have done is technically unique, or will generate revenue
and may become a high demand item, then giving up the copyright or
source code would be a bad idea. In most cases, (outside of
employer/employee relationships) the fair thing to do is to allow the
source and copyrights to go to whomever designed the application.
That may have been you, or it may have been him...

The best advice is, of course; retain a lawyer for your business needs...
